These Terms of Use (“Terms”) govern your use of bwix.vcsms.co and any communications programs operated by Bwix (“Bwix,” “we,” “us”). By using this site or signing up for our messages, you agree to these Terms.
1. About us
Bwix is a 527 political organization (campaign committee) engaging voters through get-out-the-vote and volunteer programs. Content on this site is political communication.
2. Use of this site
You may use this site for lawful, personal, non-commercial purposes. You agree not to:
- submit false, misleading, or fraudulent information, including a phone number you are not authorized to enroll;
- interfere with or disrupt the site, its security, or its infrastructure;
- use automated means to access, scrape, or submit to the site without our permission; or
- use the site to violate any applicable law or the rights of others.
3. You must be authorized to enroll the number you submit
By submitting a mobile number, you represent that you are at least 18 years old and that you are the subscriber or customary user of that number, or that you have the authority to consent on the subscriber's behalf. If a number changes hands, notify us immediately so we can stop messaging it.
4. Text messaging program (SMS disclosures)
Program: Bwix Alerts. When you opt in at bwix.vcsms.co/sms, you agree to receive recurring automated text messages from Bwix containing policy alerts, action requests, and event updates. Message frequency may vary.
Message and data rates may apply. Consent to receive text messages is optional and is not a condition of any purchase, donation, or service.
Opting out: Reply STOP at any time to cancel and receive no further messages (you may also reply STOPALL, END, QUIT, CANCEL, UNSUBSCRIBE, REVOKE, or OPTOUT, or use our web opt-out form). Help: reply HELP for assistance, or contact us at support@bwix.vcsms.co or .
Carriers: Supported carriers include AT&T, T-Mobile, Verizon, and most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Text Messaging Opt-In Data: We will not share or sell your text messaging opt-in data, consent, or related personal information with any third parties, unless required by law. See our Privacy Policy and the full SMS Program Terms, which are incorporated into these Terms by reference.
5. Intellectual property
The content, design, text, graphics, and logos on this site are owned by Bwix or its licensors and are protected by law. You may not reproduce or distribute them commercially without our written permission. Sharing our public advocacy content for non-commercial purposes, with attribution, is permitted.
6. Third-party links and services
Our site may link to third-party websites and services, including donation processors. We do not control those services and are not responsible for their content, terms, or privacy practices. Review their policies before using them.
7. No professional advice
Information on this site is provided for general informational and advocacy purposes. It is not legal, medical, financial, or professional advice, and you should not rely on it as such.
8. Disclaimer of warranties
This site and our communications programs are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure, or that messages will be delivered without delay.
9. Limitation of liability
To the fullest extent permitted by law, Bwix will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this site or our messaging programs, including any charges imposed by your mobile carrier.
10. Indemnification
You agree to indemnify and hold harmless Bwix and its officers, directors, employees, and agents from any claim arising out of your breach of these Terms, including submitting a phone number you were not authorized to enroll.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the “Last updated” date above. Continued use of the site after a change means you accept the revised Terms.
